Default Rental Property Rights?

Ok here is my question? My parents have owned 3 single family rental properties in NYS for about 10 years now. Recently one of the homes has been vacated and is now empty, I have a 7 year old daughter that is very close to her grandparents and see's them almost every day, the house that I want to rent is right around the corner from them and would work out perfectly. My mother is all for it and really wants me to move into the place, but my father is a complete a-hole that won't go for it (he has always been an asshole) My mother has NEVER seen a penny of profit since the houses we aquired and payed for, he has always horded the money from them. My question is, What can she do to insure that she has the right to rent me that house? The house's are in her name to.. Can I just pay her the rent and she can write me a receipt or do we have to do it through the legal system.. thanks wondering in ny

I would definitely suggest getting an attorney. Follow this link http://www.whinersguide.com/Lawyers.php to your State's Bar association. Things get very very sticky when you have 50/50 ownership.
