Default Can I claim my son on my taxes?

This year my girlfriend and I had to live with her dad for a few months to get back on our feet since I was laid off. Well we have a one year old, and I'm wondering If I can still claim him. Her dad is claiming her since shes only 19 and we lived here most of the year. If he claims her, even though she hasnt worked at all so she wont be filing taxes herself, can I still claim my son and get the eic? Or will there be a problem?
